Frequently asked questions about mediation

We explain technical and practical aspects of building agreement in difficult multi-party projects.

For how many parties simultaneously do you conduct mediation?

We specialize in projects involving 3 or 4 independent entities. With such a number of partners, interests often exclude each other. Our mediator ensures that each party can finish their sentence, preventing chaos during the session.

Does a signed settlement have legal force?

Yes, a settlement concluded before a mediator and approved by a court has the power of a court judgment. This helps avoid a lawsuit, which in commercial cases often lasts over 2 years. Since 2017, we have helped close 47 such cases out of court.

What if one partner blocks every proposal?

Honestly, it's rarely just about bad will. Usually, it's about communication errors or different understanding of contract terms. We look for touchpoints in hard data. If after 4 hours of talks we see no room for compromise, we inform you openly.

How long do you have to wait for the case to close?

Most disputes within a consortium are closed within two sessions of 5 hours each. The entire process, from reporting to signing the protocol, takes an average of 11 business days with us. We act quickly because we know downtime in investments generates high penalties.

Where do facilitation sessions take place?

It is best to meet on neutral ground at our office at Roosevelta 22 St. in Poznań. This helps cool emotions. Upon request, we also travel to clients or rent a conference room in a convenient location so that no one feels like a guest of the opponent.

Do mediators act as our lawyers?

No. We are impartial moderators of the process. We analyze facts and contractual provisions to help you find a way out of the deadlock, but we do not take any side. Our task is to build an architecture of compromise, not to fight on someone's behalf.
